Terms of Use

1. Eligibility and accounts

You must be legally able to enter into these Terms. If you use the service for an organization or another person, you confirm that you have authority to do so. Keep your account information accurate and your access credentials secure. You are responsible for activity under your account.

2. The service

During The Dash lets you create, store, schedule, send, and receive text, audio, video, and other messages. Features may vary by device, location, subscription, or app version. We may improve, change, suspend, or discontinue features as the service evolves.

3. Your content

You keep ownership of the content you create. You give During The Dash a limited, worldwide license to host, process, reproduce, transmit, and display that content only as needed to operate, secure, and improve the service and follow your delivery instructions.

You confirm that you have the necessary rights and permissions for everything you upload, including information about recipients and content featuring other people.

4. Scheduled messages

You are responsible for checking recipient details, dates, delivery conditions, and message content. Scheduled delivery can be affected by account status, connectivity, device settings, unavailable contact information, legal requirements, or events outside our reasonable control. Do not rely on the service for emergencies, legal notices, medical instructions, or other time-critical communications.

5. Acceptable use

You may not use the service to break the law; infringe rights; impersonate others; harass, threaten, exploit, or deceive anyone; distribute malware; interfere with the service; access another account without permission; or upload content that is unlawful or seriously harmful.

We may remove content or restrict access when reasonably necessary to protect users, comply with law, or enforce these Terms.

6. Subscriptions and purchases

If paid features are offered, prices and billing terms will be shown before purchase. App-store purchases are also subject to the applicable store’s payment, cancellation, and refund rules. Except where law requires otherwise, fees are non-refundable once charged.

7. Third-party services

The service may use or link to third-party platforms, including app stores and communication providers. Their terms and privacy practices apply to their services, and During The Dash is not responsible for third-party content or availability.

8. Intellectual property

The During The Dash name, branding, software, design, and service content—excluding your content—belong to During The Dash or its licensors. These Terms do not grant you rights to use our trademarks or copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the service except where law permits.

9. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted operation, permanent storage, or delivery at an exact time.

10. Limitation of liability

To the fullest extent permitted by law, During The Dash and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, profits, goodwill, or opportunities arising from your use of the service. Nothing in these Terms excludes liability that cannot legally be excluded.

11. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you materially breach these Terms, create risk or harm, or if required by law. Provisions that by their nature should survive termination will remain in effect.

12. Changes to these Terms

We may update these Terms as the service or legal requirements change. We will post the revised Terms with a new effective date and provide additional notice when required. Continuing to use the service after the update takes effect means you accept the revised Terms.

13. Governing terms

Applicable law governs these Terms without regard to conflict-of-law rules. Before starting formal proceedings, please contact us so we can try to resolve the issue informally. Any mandatory consumer protections available where you live remain unaffected.
